My father did 2nd marriage without divorcing 1 st wife in 1989. I am child from 2nd marriage. But His 1st wife passed away on 2016. In 2018 my father did registration of 2nd marriage after death of 1st wife. My father was with till his death from 1989. He passed away on month of September, 2021. Now what will be legal rights of my mother( 2nd wife) and me( child from 2 nd marriage). My father registered my mother( 2nd marriage) as nominee of his pensioner. As the 2nd marriage is registered after birth of me, am I considered to be legal? Please help us. Me and my mother was used to take care of my father

yes you have equal rights on your fathers property and no one can snatch the same from you be it property, money or anything whatsoever, there is nothing to worry at all, after your father goes away. if you want you can ask your father through your lawyer what shares are there in your name, if any issue arises, you can take action immediately thereafter

the second marriage may be termed as legal as your father did registration of marriage after the 1st wife passed away so the 2nd marriage wife will get the pension as she was kept as nominee of his pensioner...

although you are an illegitimate child at birth but since the marriage registration of the second marriage that irregularity has been ironed out. now you not only can have claim over his property like any other legitimate child but also to his family pension if you are a minor male or unmarried female. your mother can certainly claim family pension after your father's death. as of date you are fully at par with any other child from the first marriage unless any interest has already accrued upon your step siblings before the death of their mother.
