Rights of a son in his mothers property

My father made house WILL from his name to my mother name .I have one younger sister and I am demanding my mother to divide the property to my sister and me. But my mother don't want give me property and want to give full property to sister. Can I go legally and get property share. My father got property from his grand father as WILL. And my father support to me.

If it was your grand father's self acquired property and your father that property thru., will then it amounts to your father's self acquired property. Your father has got right to transfer it to anybody thru., any means. By virtue of will your mother has become the absolute owner of the house, so she can give it to your sister. You cannot claim share in that house

Yes file a suit for partition stating it as a joint family property and take an injunction order not to transfer, gift, mortgage etc till the case is over, and by this act they are very likely to come for a compromise.
