RIGHT TO CONJUGAL RIGHTS OF THE HUSBAND

It has been close to two years since we married and we have got child he is 7 months old, we just had small issues at home and she went to her home and it's almost one year she never came back, My wife never responds to my call and their relatives are also not responding to my calls. She isnt allowing to see my child and asking why you are cming here, Can i go with few of my relatives to her place to ask whats the issue and why shes doing like that or it will be a problem when she complains to police that we came to make problem at her home. Kindly advise.

Firstly what is the problem between you and your wife? What does she want? Why does she not come and live with you? Depending upon your answer, you can go to her house with one male member and 2-3 ladies. Don't take many male members with you because she will make allegations that you have come to beat/harass her. Even if she gives Police complaint, you can explain the situation. If she still does not come then you can file a petition for Restitution of Conjugal Rights (Asking her to come & live with you). for divorce on the ground of desertion you should wait for 2 years of separation . you can also go for divorce on the ground of cruelty. collect all the evidence against your wife including the police complaint details. for child apply for visitation rights in the court.

Ya, that s well and good decision. At present u shout avoid to go there.Instead ask the elders of ur family members to go there to talk and solve the issues amicably. Evenafter also if she adamantly refused to come then send a legal notice to her and call her to come to the marital home. Is she failed, file a petition for restitution of conjugal rights .

Better consult a lawyer. Do not attempt to meet your wife or child as they may foist a false criminal case. A lawyer will guide you to bring this matter to a logical conclusion. Make sure you contact a trustworthy lawyer.

You better sort out the issue with your wife directly without intervention of the third parties. That is the best course to come to an amicable solution. In case if she is not interested to continue her life with you, you can move the Family Court for Restitution of Conjugal rights. If you are also not interested beyond a point, then it is better for both of you to seek divorce by way of Mutual Consent.
