Residence address of a party in court case

29-Jan-2023 (In Family Law)
Hello experts!! RCR and crpc 125 cases going on in family court. Husband mentioned his office address in case title, not his residence address. Wife is currently insisting husband to reveal his residence address, but husband doesnt want to disclose this residence. Questions: 1. Does wife (or in general.. opposite party in a case) has right to ask for opponent's residence address - if so, which Act/Section gives that right? 2. Are there any supporting judgments which husband can rely on, to avoid giving his residence address.. on the ground that office address is already given and he is reachable there for summons or anything else. Thanks in advance!

Dear Sir/Madam, 1. Does wife (or in general.. opposite party in a case) has right to ask for opponent's residence address - if so, which Act/Section gives that right? Ans: Yes, it is fundamental right of a party to get the address of the opposite party. Court can refuse to register case, if registered it can dismiss the petition. Application under section 91 of crpc may be filed. 2. Are there any supporting judgments which husband can rely on, to avoid giving his residence address.. on the ground that office address is already given and he is reachable there for summons or anything else. Thanks in advance! Ans: The negative conduct of the party leads to passing adverse orders. ========================================== Section 91 in The Code Of Criminal Procedure, 1973 91. Summons to produce document or other thing. (1) Whenever any Court or any officer in charge of a police station considers that the production of any document or other thing is necessary or desirable for the purposes of any investigation, inquiry, trial or other proceeding under this Code by or before such Court or officer, such Court may issue a summons, or such officer a written order, to the person in whose possession or power such document or thing is believed to be, requiring him to attend and produce it, or to produce it, at the time and place stated in the summons or order. (2) Any person required under this section merely to produce a document or other thing shall be deemed to have complied with the requisition if he causes such document or thing to be produced instead of attending personally to produce the same.
