Regarding prerequisites of special marriage act in india

Hi.. I m a Hindu girl going to marry catholic Christian. Our families are planning a traditional Hindu n a church wedding. However I do not wish to convert n remain a Hindu legally post marriage.. is possible for us to get our marriage registered under special marriage act ?

Irrespective of the kinds of religious ceremonies you undertake, your marriage shall be governed by the provisions by the Special Marriage Act alone as you are a Hindu and your husband is a Christian. Unless, you decide to convert yourself into a Christian and undertake the Christian ceremony then you shall be governed by the Christian Marriage Act 1872.

Yes,if both of you are adult then you can marry and register under Special Marriage Act. and again conversion is your wish and your decision.
The parents can not lawfully restrain any of you from marrying each other. If they do, you can take police protection.

The parties to the marriage shall give a notice in writing to the marriage officer of the district, on receipt of the notice if any person objects then the marriage officer shall hear and conduct inquiry in this regard and conclude the same. if the marriage is solemnized then the marriage certificate shall be given by the marriage officer.

When it was celebrated under the Hindu Tradition and customs, by that poof you can claim your marriage as Hindu Marriage. As you told, if the same was solemnization under the Christian Customs, aromatically it attracts the Special Marriage Act. Normally in church they will enter your names and it will be entered in the ledger book.

Therefore, to remain as Hindu and to certify your marriage as Hindu Marriage, you do one thing that as you informed your parents will planning to solomanise your marriage as per Hindu rituals, on the basis of the photographs and other relevant materiel which is collected during your marriage which is done under the Hindu rituals and customs. on that basis you registered your marriage as per Hindu marriage and your religion will be safe.
