Property rights in case of divorce/separation/abandonement

Hi, My wife left the marital home (where we stay with my parents) and went to her parents place 4 months back, citing mental harrasement. In such a case will i be considered to have abandoned the marriage? Can it lead to her getting any rights on a property I am planning to purchase solely in my name ?

hi

in this case she has only residential rights in the said property. no ownership rights are there in existence as of now.

you may send her notice of restitution of conjugal rights to resume marital life so that she will not claim divorce and maintenance

If suppose she files criminal application under the provisions of Domestic Violence Act then she can claim accommodation protection with interim maintenance. If suppose till today nothing is by your name then don't purchase any property by your name until your matter get sorted.
