property issue post divorce, property transfered to children

03-Oct-2023 (In Family Law)
My friend agreed not to claim any rights over property that was in her name and would provide general power of attorney. However the ex-husband asked her to sign the sale deed, but she refused and later transferred the property to the children through a gift deed. what repurcation can be there for her. She is a Hindu

You can take any action in this case bcoz title owner has right to transfer her property to anyone else ! It might hv come under cheating etc if she would have taken any consideration from you and thenceforth would have transferred the property to her children

You need to get the documents legally perused from a lawyer and seek a detailed legal consultation for your issue. Need to see and analyse the order where she has waived off her rights. Further would like to see the title documents and gift deed.

If the property title documents are on the name of your friend then she has full right to give it to anyone. She can not be deprived to exercise her rights over the same. However if there is any settlement agreement signed between the husband and wife, then husband can seek cancellation of the gift deed. For any better clarification feel free to contact Thanks
