Property is not getting divided equally - Grandparents are alive

My uncle is harassing my family and have threatened my grandparents to not divide the property equally. They want to divide in equal and fair parts, but since their mental and physical health isn't quite alright they aren't able to raise their voice. We tried convincing and talking with Uncle, he isn't ready to listen to a single word and always start to shout whenever the matter comes. Any suggestions/help would be really appreciated. Hindu Family

you can file partition suit in which every one will get the equal shares of the property no one can stop or do any illegal thing to obtain extra share in property it will be equally divided among every legal heirs...

see there are two ways to deal with it one is being grandchildren file a case with grandparents as parties to a proceeding and file a case in court of law to pull ur uncle to court and get your uncle out of the property over courts order there are recent high court orders to the effect; secondly file a partition suit and get it dragged for 20 years in court purposefully so that your uncle without courts order cannot to anything and make each and everyone a party to the case

Its very difficult to suggest without knowing the ground situation which can only be explored after having a consultation session with client. in any case I think one can explore the avenues like making a will or testament another option would be to invoke senior citizen act to ensure your uncle is precluded from intimidating your grandparents etc.
