Property dispute: inheritance of the property with no will. Help!!!!!!

My grandfather has left his property without any will. My aunts are causing a lot of trouble for the division as well as the succession of the property. They are even asking for rights in the house we live. Can I get to know about some actions that can be taken against them ? And how this property dispute can be sought and do then actually have any rights even in the house we are living from past 20 years ?

Since your grandfather died inestate that is without leaving any Will, you have to get the succession certificate by filing a succession petition before the concerned Court. So far as right of the married daughters are concerned, it has to be seen whether your grandfather died before or after 2005. After the advent of the Hindu Succession Amendment Act, daughters are also entitled to equal share in the ancestral property of the father. In this regard, I advice you to first see and make a list of all properties which were self acquired Property of your grand father, as will can be made only in respect o the same. And other property which are joint family property will devolve upon heirs as per the Indian successions act. Then you need to see if grandfather died after 2005 or not as amendment by which daughter had share in the property was given effect in year 2005 and then you need to see if preliminary decree was passed before that date.
