Procedure in case of Mental torture and false blames by husband.

18-Oct-2023 (In Family Law)
Hello. I m married since last 1.5 yrs. My husband do not have mother but have 70yr aged father, two elder married brothers. We r hindu. After my marriage i worked outside for 10 months and then shifted my job to another company at lower salary so i can live with my husband. I lived 5 months with my husband & his family. Due to continued taunts i left my husbands place. My husband brought fight with me when i asked separate kitchen as i do not want to take food at his bhabhi's floor. My husband used to purchase things for his brother, bhabhi & children but hardly anything for me. Whenever he used to buy things he used to taunt for expenses. My husband used to taunt me for money stating he alone running the house. My husband used to hide his credit card and debit card bills. My husband blames me for leaving him when he was dying. My husband used to call my parents at their house on every minute issue. My husband used to demand rs. 1lakh which he had given me while i was leaving my job.

You can file a case against your husband under Section 3 of the Domestic Violence Act and under Section 498A for Dowry. And also for separation under Section 13b of the Hindu Marriage Act on the grounds of cruelty.

Hi, In your case , My reply is as follows: 1.You can go to the court for blaming him for Cruelty. 2.You can also lodge a FIR against him for the mental harrassment he has doing to you. 3.Need to know some more details are you residing with your husband currently or not? If you are reside seperately , and need to go to your inlaw house than you can approach the court for the restitution of your conjugal rights. Hope this will resolve your query. Thnx
