Procedure for partition of Ancestral property among family members.

20-Dec-2023 (In Family Law)
Ancestral property with no will has to be split between 9 members. Along with land, there are 2 adjoining shops to be partitioned. Now family member A runs business using this 2 adjoining shop. Family member B wishes to get one of that shop alongwith an equal split in land. Now everyone agrees on the land. And every other family members support A's wish to keep both shops and keep his business intact. Family member A even offered family member B some money for letting go of the shop and hence end the deadlock. However family member B is adamant about one of the two adjoining shop and hence partition is on a standstill. How can we end this deadlock? What if every other family members support the claim of family member A to keep the shop intact..? Would that help?

Dear, This is your grandfather property did he make any will before he died and if not then you all have equal rights on this property. You may approach the civil court for the proper separation of the property. But nobody forcefully pulled you out from that property and if anyone did so you may filled a police complaint against them

The query suggests no legal elements. Try to work out an amicable settlement, else a suit for partition could be filed.

From your Querry I Can understand that the property is to be partitioned amount 9 members and there is a dispute between A & B. If he other 5 family members releasee their right over the property, in favour of A, then A will get 6 share and B has only one share over the property. In such a situation, even if B approaches the court, A may success in getting the share of B also by paying consideration
