Q: What to do if the case is pending since four years
I have filed one civil case in the munisif court and the court has issued ORDER favour to me. The case is that one person has taken land sand from my land for Rs.50000. I have received the agreement deed from the opposite person. But he didn;t pay the amount. Now 4 years are gone. Still the case is pending due to impossibility to issue warrant to that person. Aournd 8 items the warrant has been issued. But the Ameen whent to the home of him and he is not able to issue the same due to the absence of the criminal. Let me know the next procedure to receive the amount. The oposite person has no land or any other property in his own name.

from the details granted by you, I suppose that , your case was decreed, and now an execution petition is pending. and the warrants issued by the Munsiff court were returned unexecuted. In these circumstances you can file a petition for police assistance and obtain an order for that ...

I am citizen of India, and I was married for 8+ years to a Doctor from Kerala. Due to various reasons our marriage did not sustain and in Aug 2016 we filed a mutual consent divorce. We got divorced in May 2017. We have a son 5yrs old. I am not his biological father due to my medical condition. He is a donor child. The donor treatment was done with consent from both of us. After divorce my ex wife does not allow me to meet him even though I have visiting rights as per the divorce decree. If I file a case against my ex wife what % of chances to I have to get to see my son.

If you have a visitation right as per the decree, you need not file a separate case, you only need to file an Execution petition, to execute the decree. The court will allow visiting right / interaction/ interim custody as per the decree above mentioned. Even otherwise you may also file a case for custody court will allow visiting right / interaction/ interim custody as per the circumstances of the cases..
