Parenting order/ documentation
25-Jun-2025 (In Family Law)
I live in NewZealand and my mum is in India and she got kicked out of the house by my younger sibling and my mum didn’t have anywhere to go . What can I do?
Also the sibling would not give my mums passport/documents for me to able to bring her overseas. They are trying to claim her pension. Is there any way for me to stop this?
First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either stop all these harassments or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime get a complaint drafted and address the same to the police station according to her jurisdiction. For more legal assistance I am just a call away.
Hello sir/ madam
If your mother is a senior citizen (60 yrs or above), the most efficacious and speedy process to restore her back in her house is to file a petition under senior citizen act before the concerned DM office with maintenance to be provided to her by your sibling. All you need is a good Advocate who can draft and present your case. Good luck!
you can first approach your local authority in India, file a police complaint for illegal eviction, harrasment and withholding of the passport. Also, can file a case under the maintenance and welfare of parents and senior citizen Act 2007. if property is in possesion of your mother they cannot do so.
and if there is threat of claiming your mothers pension. then first of all send a written note to the bank or pension authority that do not transfer or altered anything without your mother's consent.
