Q: Provision of Disowning or reverse adopted child
I adopted a 8 months kid from adoption center ,now she is 15 and showing extreme behaviour issues and even tried to hurt herself if try to discipline. When she was 8 years old I got divorced and now she blame everything her misbehave with me on divorce and other dirty things she is inclined to share online. i don't see a way to discipline her besides disowning her as extreme solution. is their any provision of it in India.
Advocate Prachi Chaturvedi answered
Adoption is permanent in eyes of law. It cannot be revoked or cancelled. despite having any issues with the child. You cannot think of disowning them. The day you adopt you become the legally responsible parent for their care and upbringing. Now to discipline your child, first not to make extra pressure, give little space under your observation.try some therapy session talk to your child listen him, may be he or she is going through with something.
Q: Can I attend online court session for my divorce case
Can I attend online court session for my divorce case and Sec498A case already running in courts.
Advocate Prachi Chaturvedi answered
yes you can but with court permission through your lawyer with a genuine reason as in some stages physical presence is needed and in the first hearing physical presence is must. VC i.e virtual hearing is not automatic in these cases. so permission is needed but after your first physical presence.
Q: Parenting order/ documentation
I live in NewZealand and my mum is in India and she got kicked out of the house by my younger sibling and my mum didn’t have anywhere to go . What can I do?Also the sibling would not give my mums passport/documents for me to able to bring her overseas. They are trying to claim her pension. Is there any way for me to stop this?
Advocate Prachi Chaturvedi answered
you can first approach your local authority in India, file a police complaint for illegal eviction, harrasment and withholding of the passport. Also, can file a case under the maintenance and welfare of parents and senior citizen Act 2007. if property is in possesion of your mother they cannot do so.and if there is threat of claiming your mothers pension. then first of all send a written note to the bank or pension authority that do not transfer or altered anything without your mother's consent.
