Parent misusing senior citizen act

My father who is a senior citizen is using the senior citizen act to evict his children from his property. He is misusing the act as he has been harassing and abusing all his family members (wife and children) and mistreating them. He has been aggressive throughout his life and now just for his own comfort, he is misusing the sections under the senior citizen act. Please advise how can children protect their rights

You can file police complaint under section 356 of BNS and section 248 which is malicious prosecution. Misusing law and initiating false proceedings is a criminal offence under law. For further clarification feel free to reach me.

If the property is self owned then he has the full right to enjoy his hard earned money if the porperty is inherited from his ancestors then you full right to claim over the porperty If case of swlfpwned property mother can claim her right by file multiple cases like maintainence dv act

Well senior citizenship act is for the welfare and protection of senior citizens and it provides shelter and maintenance to the senior citizens. You can stop giving any amount of money to him and shift to a rented accommodation. After that, he will be requiring money for maintenance. As per the act, the maximum amount of money which a senior citizen is entitled is 10k and when he will be requiring money and physical help, he will learn what he had done. For more and precise strategy, I would suggest you to have a counselling session
