Ownership rights for jointly owned properties by husband & wife

Does wife as co-owner of a flat have the same rights as husband even without any financial contribution in acquiring the flat? Does husband have an upper hand ?

if the flat has been purchased in joint name both will be the owners and will have 50 percent rights, husband does not have any upper hand and only in case wife files for maintenance etc he may get some benefits and bit favourable orders in his favour.

Dear Sir, If wife does not contribute for the purchase of a flat she cannot claim 50% of the flat ownership. You may file a suit for deletion of her name since you had included her name on love and affection and now there are differences between you as such you wish to get ownership of entire property by yourself since you are paying all the EMI's.
