One lady made a video of my belongings and published in Whatsapp group

12-Apr-2023 (In Family Law)
During my workout session, while I was in between my exercise schedule, my aforementioned articles were kept outside the bag and were being used by me. At this point, without my knowledge or consent, a lady took certain photographs and videos of my articles and posted on Whatsapp group of the ladies of the Society and made libelous remarks against me on the said group. nA few years back, a similar incident had occurred in the Gymnasium she made snide remarks against me during my exercise session and same thing happened on 18th February 2022. nCan I sue her for defamation and harrasment?

Yes…you can always sue her. It’s a clear case of defamation because she is dispensing your personal belongings and even transmitting it in her ladies WhatsApp group. You can also claim compensation for her act. For more legal assistance I am just a call away.

When we take video and images from social media and other websites accessible to the public, they may reach a wider audience. We should consider the privacy of those featured, particularly where they did not make or publish the recording, and whether any further consent is required. We should also consider the potential impact of our re-use, particularly when in connection with tragic, humiliating or distressing events. but yes you can file a complaint under sec 354c IPC for taking video and uploading at social media where punishment will held upto 1 years and fine will be imposed also

for a defamation case the only thing which is required is publication. if you have proofs that she has defamed you by posting pictures and defamatory statement then it's a good case to file civil or criminal defamation.

Yes, you can sue her for defamation. provided you have the screenshot of the libelious remark made by her against you which clearly establish the mens rea for defaming you. you can take a stay against her and can also claim compensation for the same. Please note that the remedies are dependent on facts and circumstances of the case so the proper recourse is query specific.

Yes you have an option to issue a legal notice first and ask her to tender an unconditional appology. Further you can file a suit for dafamation against the concerned lady and seek injunction and damages
