NOMINATION ISSUE WHEN NO LEGAL HEIR OR WILL BY THE BANK DEPOSITOR

08-Feb-2024 (In Family Law)
My brother who was a Church priest expired in Oct. 2023 and no heir or will was there on bank account/FD etc. I being his next close sister just 1 yrs younger to him was nominated at the bank account. On getting the death certificate applied to bank for the nominated amount. Now my other brothers and sisters are stressing to give my pass book and all accounts to calculate the amount and give all equal share. What the law or court order says. They are all abusing and threatening me to pay

The nominee gets the benefit of the monies left behind by the deceased for their nominees whole and sole use. If there was no nominee then they had a claim. Lodge a police complaint against your siblings who are threatening you and abusing you that way they will not interfere henceforth.

Dear Sir, Every law of succession defines the rules of distribution of property in case a person dies without making a will. The Christian Law of Succession is governed by the provisions in the Indian Succession Act. However, with respect to Indian Christians, the diversity in inheritance laws is greatly intensified by making domicile a criterion for determining the application of laws. Till January 1986, Christians in the State of Kerala were governed by two different Acts – those domiciled in Cochin were subject to the application of the Cochin Christian Succession Act,  while the Travancore Christians were governed by the Travancore Christian Succession Act. These two Acts have now been repealed and the Christians following these laws earlier are now governed by the general scheme of inheritance under the Indian Succession Act
