Q: 1yr of marriage but have been living separately for less than a yr
My husband an i plan to file a divorce. We have not been together for a month and completion of June (our 1st year completion) would be 3 months. However under one of the conditions of mutual divorce is 'Both parties must mutually agree to the divorce, and it must be established that they have been living separately for at least one year before filing the petition'. Would the divorce still stand valid? or should we wait a year to file?

You can file application seeking waiver of the one year period of having stayed separate and get it allowed by placing relevant arguements before the court. The court if convinced will pass necessary orders and there after file another application seeking to waive off the 6 month waiting period. That way the court can be considerate of these circumstances such as one party leaving the country /city and take up your case as a one off case to allow the applications

Hi,My husband ran of from home in 2019, left me and my son. Till now no contact with him.I want to file divorce, is it possible to get divorce without him.

Yes. It’s possible to get divorce in his absence. Do you have a possible address that he can be staying in? Such as his parents place. Place of last residence. We can send the notice to that address and thereafter take paper publication. Also the address in the Aadhar card (if you have his Aadhar card) will also help.

Initiate a divorce petition putting forth all these allegations. Once a divorce case is filed, any action/complaint filed by her will look as a counter blast and the same will not have same effect as her approaching the police / court before the divorce proceedings. If the child is in your custody then file a case for custody of the child as well in order to protect the child from being taken away from you illegally.

I am working and living in Bangalore and my husband has filed a divorce case under section 13 in Lucknow family court and I have received summon. What do I need to do as I can't travel back and forth with my small kid.

You can file a transfer petition before the Supreme Court seeking transfer of the case to Bangalore as you stay here with your child. You can state that you have difficulty in travelling and also that you do not have the finances to travel that far. The Supreme Court will take into consideration these aspects and transfer the case to Bangalore.
