Q: daughter in law abusing mother and father in law

My youngest daughter-in-law has physically abused me, treated me like a slave, and pressured me and my husband to leave the house. She demands the property be transferred to my son's name and is threatening to file a 498A case and divorce him. She has left the house and is pressuring my son to stay with her. We cannot live without our son, and he doesn’t want to leave us. What should we do? Please help us. he is our second son. my elder son already leaving separately.

Advocate Ankith S Reddy answered
Assuming you're a senior citizen. we can file complaint against your daughter-in-law under the maintenance and welfare of senior citizens and parents act. Get an FIR lodged against her before she takes any action such as a police complaint and/or file a police complaint against you all. Any action she takes after will look like a counter to your complaint.

Q: Cash Loan given to Neighbour On Tust In Case Of Emergency

Cash loan given to neighbour in case of emergency on tust now refusing to pay can I file case in court he has given cheque how much it will cost

Advocate Ankith S Reddy answered
You can file a cheque Bounce case against him provided the cheque has not crossed more than 3 months since the date of the cheque. There will be no court fee that needs to be paid the court. You will have to bear the advocate fees and allied expenses such as out of pocket expenses

Q: 1yr of marriage but have been living separately for less than a yr

My husband an i plan to file a divorce. We have not been together for a month and completion of June (our 1st year completion) would be 3 months. However under one of the conditions of mutual divorce is 'Both parties must mutually agree to the divorce, and it must be established that they have been living separately for at least one year before filing the petition'. Would the divorce still stand valid? or should we wait a year to file?

Advocate Ankith S Reddy answered
You can file application seeking waiver of the one year period of having stayed separate and get it allowed by placing relevant arguements before the court. The court if convinced will pass necessary orders and there after file another application seeking to waive off the 6 month waiting period. That way the court can be considerate of these circumstances such as one party leaving the country /city and take up your case as a one off case to allow the applications

Q: Divorce without husband no one is at any of there homes.

Hi,My husband ran of from home in 2019, left me and my son. Till now no contact with him.I want to file divorce, is it possible to get divorce without him.

Advocate Ankith S Reddy answered
Yes. It’s possible to get divorce in his absence. Do you have a possible address that he can be staying in? Such as his parents place. Place of last residence. We can send the notice to that address and thereafter take paper publication. Also the address in the Aadhar card (if you have his Aadhar card) will also help.

Q: Urgent support/advise needed regarding to the Matrimonial issues

My wife has displayed manipulative behavior, often resorting to fights if her wishes are not fulfilled. Over the past 6 years, I have endured physical and mental suffering due to her aggression and violence, particularly towards our child. There have been instances where she has left our home, only to return with her family members to forcibly take away belongings, including gold given to her during our marriage. Now, her family is resorting to threats and saying they wil file a case.

Advocate Ankith S Reddy answered
Initiate a divorce petition putting forth all these allegations. Once a divorce case is filed, any action/complaint filed by her will look as a counter blast and the same will not have same effect as her approaching the police / court before the divorce proceedings. If the child is in your custody then file a case for custody of the child as well in order to protect the child from being taken away from you illegally.
