Need living separately legal document
08-Jun-2023 (In Family Law)
I am Hindu, married in Apr-2012. I am living separated from my husband past 3 years., due to strained family conditions. During my first 2 years of stay with my in-laws, I have faced emotional and physical trauma. During the period when I was pregnant, my sister-in-law, came to stay with us and this subsequently increased the trauma I had to face. After few months, I moved to my parents house and have been living there since then. We are blessed with a baby girl. However, my husband nor his parents never invited us back to their home and when we went to their home but they did not allow us and closed the gates on our face. I wish for a reconciliation in the future. I need of a legal document saying my current status. Is this document called the legal separation document? What is the process for the same and how can I get it? Is it possible for somebody to get the same from a lawyer, without going to court. Basically, I am NOT interested in divorce but need this legal document.
No, it is not a document of status for your single status. Rather it is a proof that you alone live on that address. For getting a status you need to file a suitable suit in jurisdictional court and obtain order.
Madam, u can leave separately with out any trauma and trouble, try to speak with ur husband and tell him to come and live with u and child , there is no documents needed for staying separately ,if u wish are want ur husband only to come and stay u can ask/ file a case for same.without divorce u can only file a complaint in police station for not disturbing or harrasment, can also safeguard ur self and child from future problems from ur in laws and husband.

In a legal separation, the parties are still married, versus a divorce where the marriage is ended. A legal separation is a court order that mandates the rights and duties of a couple while they are still married, but living apart. In a divorce, the spouses are no longer married. Legal separations are not too common, but can be helpful to a situation where the spouses work through any personal or financial issues affecting the marriage. In proceedings for legal separation, the court decides the following, much as it would in divorce proceedings:
Separation maintenance: this includes spousal and child support, but is called something different to distinguish it from the effects of a divorce. The court papers for separation maintenance are usually filed by a lawyer through what is referred to as a "motion pending litigation". The court's decision on awards for separation maintenance does influence what each spouse is awarded should they later continue to divorce proceedings.
Child custody
Child visitation
Property division
Property division during legal separations and divorces are typically determined by the couple's situation and how it relates to the property. The following situations are common forms of separation affecting property division.
