If you are interested in divorce then you can file for contested divorce as it does not require the consent of other party(wife). But in that case also you will have to pay some maintenance to your wife until she remarries. In case of 498A you can go for quashing of FIR but the chances of quashing will depend upon the facts that has been stated in the FIR. It is better you file for Anticipatory bail in the sessions court where the case has been filed.

if the case of 498A is false and frivolous ,you can file a petition of restitution of conjugal rights if you want to stay with her but if you want to live separate then you have to set a ground for divorce and for this you need to provide more details of the matter. for further assistance feel free to contact.

hello the first and foremost thing that you have to do is that you have to appear in the 498 case I guess you have already appeared and also in the maintenance case and fight on merits if she is not ready to stay with you. further you can also take the decision of filing a diverse case probably helpful to you because I sing the situation it doesn't seem that she will be staying with you you and your family to file a divorce case so that you can get a final relief
