my mother not willing to sign registration
14-Apr-2025 (In Family Law)
we had married for 9 months now and most of the the time we end up in small fights. they talked bad about my mother in the flow during one phone call. now she is not coming for registering our marriage as parents witness. can me and my wife register without my mother, will it be morally good ?
S Gunasekar advocate answer.
Yes, legally, you and your wife can register your marriage without your mother being present as a witness. The law typically requires two adult witnesses from either side (they don’t necessarily have to be parents), so you can choose someone else—relatives, friends, or even neighbors—as witnesses.
But the moral angle is more personal.
If your mother is hurt because someone spoke badly about her, it’s natural for her to feel distant or unwilling to participate. In such a situation:
Talk to your mother first. Explain how important this moment is for you and ask her gently if she’d reconsider. Try to clear the misunderstanding or hurt caused.
If she still chooses not to come, you’re not doing anything wrong by going ahead with the registration. You're not disrespecting her; you're simply fulfilling a legal step in your marriage.
In short: Yes, you can register without her. And while it’s always better to keep family involved, sometimes you have to move forward if they’re not ready—as long as you’ve tried to mend things respectfully.
Would you like help writing a message to your mom to express your feelings or explain your situation gently?
If both the Couple are Hindu they can register a marriage under Hindu marriage act, to register under Hindu marriage act needs signature of parents of both the sides. If any of the couple is not another religion they can register marriage under Special marriage act, they have to inform in 30 days prior to register the marriage in Special marriage act, for registering under Special marriage act parents signature is not necessary only witness signature from both the sides required. feel free to connect for any further queries.
There was a legal requirement that the girls parent that is, the mother should sign the marriage registration, but however the same was practically relaxed by the sub registrar office in Tamil Nadu. Therefore, it is not required that you need to take the wife’s parents to the rest of us to perform the registration, however, you need to provide three witnesses at the time of registration of marriages. You can get in touch with me if you have any worries in this particular matter.
