Mutual divorce settlement help needed for divorce

What is the process for Mutual divorce as per indian laws. She was caught with affairs with her neighbour before and after marriage. That only I comes to know after marriage. We have whatsapp chats proofs only. The girl accepts. But we are going with Mutual first. If she agree..I am a govt employee and earn nearly half than her. What about alimony ? Also we never asked them to spent on marriage. We spent all for marriage on the account she is the only bread winner in her family. marriage only went for 6 months and her parents also took her when she was exposed. Not living since 3 months. Pls help.

Query perused. Divorce by mutual consent has to be filed in the court havibg competent jurisdiction where the marriage was solemnised or where the parties last resides. First motion will take place immediately upon filing thereafter normally parties have to wait for 6 months for 2nd motion to happen. However, the same can waived off by moving an application. In case your wife does not agree for a mutual divorce, you need to file a divorce on grounds of cruelty. The best and easiest way to get divorced is mutual divorce. Both of you can engage a single or two advocates each and discuss the terms of settlement. The terms of settlement can be mutually decided.
However, if her demands are unreasonable and you are not able to settle the matter, you should not waste time and file for a mutual divorce beforefamily court. You will have to mandatorily undergo mediation during court proceedings wherein both of you might end up settling the matter after which the divorce can be converted into a mutual divorce.
