You can file a divorce petition by mutual consent under section 13 of the Hindu Marriage Act before the he family court. So far as jurisdiction is concerned it can be filed at a place where the marriage was solemnised or where the parties last resided together or where the respondent at the time of presentation of the petition resides or in case the wife is the petitioner, where she is residing in the date of presentation of the petition.
