Mother files false complaint of harassment
12-Jan-2023 (In Family Law)
My senior mother files false complaint of harassment and abuse against me and my wife under the instigation of my younger brother. I being the eldest in the family, they want to throw my wife and me out of the house which was built by my father and myself around 30 years ago. I am staying for more than 25 years in the same house. My family are Christians. Please advise.
Dear Sir,
You can file partition suit under the provisions of Indian Succession Act and get an interim order to maintain status quo thus you can continue your stay in the same building. After issuance of notices the matter may be referred to Lok Adalath for settlement or it will be decided on merits.
For now, you can defend the complaint (if there has been a formal complaint filed with the PS), and file a counter complaint with the jurisdictional PS iterating your grievance and the relief you need from them)
Subsequently, depending on what remedy you are looking for, you can approach the court accordingly.
You can reach out to me should you wish to discuss further.
