17-May-2023 (In Family Law)
Issue happened on 16 May 2021
Issue: What would be my legal rights when wife left her husband when husband gets covid+ and moved to her Mother house on dt 11 Apr by saying that I could not take care of you and you better go to your mother's house.
Incident
I moved to my mother's house on 15 April so that I could recover from covid 19. After one month she came to my mother's house and create nuisance, bullying and used filthy abusive language for my mother and brother and for my Brother's wife too. I have already lodged an complaint against her in local police station for creating nuisance, using abusive language and harassment and for indecent behaviour. She wanted me to come back however, it seems she lost her mind and reacting very violently and at this point of time it is not safe to stay with my wife as in past she has banged her head into iron grill in 2014 to pressurize me. Yesterday also she threatened all my family members to that she will implicate false charges on them.
Hello Sir,
You can seek divorce on the grounds of cruelty towards you and your family. But you must be able to prove before the Court all that you're mentioning here in the question. Otherwise, the Court generally does not side with the Husband in cases of cruelty.
Make good evidence like CCTV footage and phone recording to prove that is happening.

In this case you can file divorce on the ground of cruelty and also get an FIR registered against her for harassment. Infact your old aged parents can also lodge complaint against her. For any further legal assistance please feel free to contact

It is advised that you should give a ittleha peshbandi ie. information report to the police station where you reside to showcase that she has been attempting suicide in past to implicate is in false case therefore it is requested to take necessary action against her till you institute a case for dissolution of marriage. As normalcy ensues with court you file for dissolution of marriage on the ground of cruelty
