HOW TO APPOINT A GUARDIAN OF MINOR HINDU WHOSE BOTH PARENTS (MOTHER + FATHER) ARE EXPIRED? GRANDPARENTS ARE ALSO NOT ALIVE, ONLY ONE SIBLING IS THERE, AN ELDER SISTER (20 Yrs) IS ALIVE.

I have perused the contents of your query and would advise you as follows : For the appointment of guardian under the Guardian and wards Act you have to file a petition under section 10 before the Family Court having competent jurisdiction. See since the parents and grandparents are not alive. The will consider giving the guardianship to the closest relative and will see the welfare of the child.

U have to an application in the court for appointment of Gaurdian and the elder sister is an adult and hence can be appointed as a Gaurdian for further guidance u can call and discuss with the details of the case concerned it should normally be done 2-3 months

since no other natural guardian is available. A public notice will be issued in the name of the minor and the elder sister since major can be appointed as a guardian. By this any proceedings will be done by the elder sister on the behalf of minor. that can be done by the court as well
