07-Jan-2023 (In Family Law)
Hi, we are Married for 19 years with 2 kids, and we both together lived in overseas for 13 years, for having problem with relationship, we had arguments. She was not happy staying overseas, So we both agreed that I will stay in overseas and I sent my wife and kids to india planning to later settle in India for few years. I have continued to stay overseas till now, and was visiting my family every year for 2 to 3 months since 5 years till now. And now she says she does not want to live with me, does not talk to me, I send money every month for full living cost and maintanace, kids schooling etc and she's planning to marry someone else and am not sure if she got engaged now, there family is also supporting her. I want to live together, so what do I do now Please advice, thank you in advance. Anand

Dear Sir, Please try for mutual divorce if she is not ready to continue to married life if you want you can take child custody. If you file Divorce case it may be ended in compromise. Normally, mutual divorce requires 8-10 months and contesting divorce requires 3 years.

2 things: One, she cannot marry or engage another without obtaining a divorce. Two, if you want her to live with you, you’d have to move the family court seeking restitution of conjugal rights. Depending on the relief you want and more details, I would be able to advice more appropriately. Do get in contact for legal assistance.
