Maintenance in case of domestic voilence
18-Aug-2023 (In Family Law)
I have been in an abusive relationship for 4 years. My husband yells and compels fights and aggressiveness. He would beat me, but I haven't filled any complaint to avoid differences. He is in central govt. He has been cursing me and my family ever since we got married. It has come into my knowledge that he has been recording my responses and my calls that I have made to him. He has very cleverly been able to record them in a way that it seems that I am cursing his family etc. Now, since December I have moved out with my 2.5-year-old daughter. Been to a counsellor etc, he has been diagnosed with strong depression. However, now he is threatening me that he will put all sort of litigation on me, to escape any maintenance against me or our daughter. How can I save myself and how can I still ask for the maintenance
Dear Mam,
In this circumstance , you can file two cases to start with. one under Domestic Violence Act and other under section 125 of Cr.P.C. Please note that getting maintenance for yourself and your daughter is your right.

You need to file multiple cases against him under the Hindu Marriage Act, Domestic Violence Act as well as under the Indian Penal Code. I am not sure what kind of evidence he has against you, but it would be really difficult for him to escape having to defend himself in such matters. All the best!
Yes you can definately ask for maintainence for yourself and your daughter also ..you csn file divorce against him on the ground of cruelty and along with that you csn file maintenance application under 25 of the hindu marriage act along with that you can file domestic violence case against him..
First of all, you need to get yourself medically examined to demonstrate that you have been subjected to physical violence and also lodge a police complaint.
If you are not a working lady, your husband cannot escape the payment of maintenance as that is his legal responsibility. As regards interim maintenance, you can go ahead and file an application under Section 125, CrPC or, in the alternative, you can file a case for domestic violence and pray for maintenance.

Hi,
you have a remedy to file a maintenance case before the Hon'ble Court. Further, it seems that your husband has been committing cruelty upon you. You may further, file a Domestic Violence petition seeking police protection. For more information, feel free to have a word with me. All the best.
