Living with the partner without marriage wants to separate now

Hi, me & partner is live-in relation for past 6 yrs.We have a baby also. Now we need to move on different direction. Should we require any legal separation to marry to marry other person? Also what about our baby? Who will take custody for him? please help
Live in relationship if your partner challenges then as per various judgements it can be termed as marriage and as the child is completely both of your responsibility without a choice you have to take care of the child or allow the court to decide

Please note that live in status is though not marriage but the obligation is no more less than any marriage. You cannot ignore your partner's and your baby's responsibility. Nevertheless the illegitimate child is also entitled to have part in the property, be it ancestral or yours.
Therefore its better to give a legal sanction to your live in relationship.
