Legal remedies in a false dowry case

my uncle's wife who is suffering from many types of body problem and her behave is also not good...therefore my unckle wants to divorce...bt her father file the case "dahej pratha" on my uncle and my parents ...that is wrong because we didn't take any type of dahej...today police came to my home for arresting.plz advice me sir what should i do

Don't be panic. You can not stop or prevent any body to file case. The best you can do to face the case with all facts. Contact a good lawyer, apprise him about all the facts a,documents and act accordingly as per his advice

Immediately file an Anticipatory Bail in district court.Police can not arrest now in such cases without giving you prior notice under Section 41 of Criminal Procedure.You can also approach High Court for quashing of the FIR.

Once the criminal case has been instituted, you will have to take the anticipatory bail. Thereafter you can take other recourses otherwise police will remain to harass you. After taking bail, you will have to prove before court your case and you can file divorce

You may immediately take steps for filing anticipatory bail application before the District and sessions judge,of the District where case has been Lodged . The court may grant you anticipatory bail . Thereafter the police will not disturb you.
