You should seek a detailed opinion from an expert lawyer on this issue. You need to file for grant of letter of administration and succession certificate in the court of law where the property is situated. Legal hier certificate would also be required but it will not be enough for you to transfer the property in your Name.

Dear clinet You will need a legal heir certificate in case it’s a bank locker. The legal heir certificate will be issued by the SDM of your area, in case your parents resided last in xyz city the SDM of that city will issue the LR Certificate Feel free to get in touch to discuss further

If your parents have got demised intestate (that means without making a will), In that case there are two things you need to understand:- 1) Succession Certificate: it’s for movable properties like money in the bank, jewellery, car etc of your parents. In case bank etc ask for succession certificate for movable properties then u need to hire advocate to file application in the concerned court n it may take at least 6 months if there is no objection from other legal heirs 2) survivor certificate: for getting immovable properties like house flat etc mutated in your name. All the best n b in touch
