Legal Heir affecting Gift Deed

27-Oct-2023 (In Family Law)
Both parents deceased by 2007. My brother has belatedly filed a OS in civil court for sole legal heir certificate and he wants a No-Objection Affidavit from me to be filed in the civil court. But, Before my father passed away in 2007., he had gifted one of his self-acquired property to me via a gift deed registered in Bangalore. Today, if I solemnly declare my brother to be the sole legal heir to my father, will it affect my legal ownership of the property gifted to me in 2007?

I ulitled understand your questions so your brother want to no objection from your in case purpes right but your father what oerpers you want to file a o S case that is important. so you collect the O S case detailes what prayers he is mentioned in his case (plaint) then only you can give the N. O. C becouse you are also legal hair your name also he can mention in case and the same time he can file the case in court so you can colect the detailed about that case.

Dear Sir, The Gift Deed in your favour cannot be cancelled unilaterally that is without your consent. You may give No Objections Affidavit for limited purpose and clearly say that it should not effect the property which is appearing in the Gift Deed.
