Legal consequences of extra marital affair by mutual consent

If a married man and married woman have extra marital affair with mutual consent then can their partners file legal case and if so how strong will b that case....

Yes in such type of relation the husband is aggrieved person and he can ledge FIR against the man who is involve in such type of relationship under section 497 of IPC, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such case, the wife shall not be punishable as an abettor.

Of course their is consequences may be her husband file a case for adulyty against you or may be rape case. Thereof may be such like situation may occur due to your negligence. Pls take precautions before

I will assume this is a case involving the crime of adultery and not divorce for adultery. The mutual consent may need to be proven either in writing or demonstrated. Cases can always be filed, but only a man can be prosecuted for adultery. For the wife, a case against her partner has to be instituted. Usually, judges don't want to get into such things and ask that the case is mutually solved.
