Legal action against husband's illegal relationship and harrasment

my father has an illegal relationship with a lady and we warned many times ...even we have call recordings for proof ...and he is harasing my mother what action can we take against him..we are hindu

Your mother can file a case for domestic violence and also she can file a case for divorce and maintenance on ground of harassment which amounts to mental cruelty, hence as you have proof of recording you can easily prove it.

You can make a complaint before woman commission or Sanvatana center. How ever see next of your father attitude and suggest him to it's harm to family life better to ovoid un accepted attitude it's better for your issue.

Protection of Women from Domestic Violence Act (2005)is a comprehensive legislation to protect women in India from all forms of domestic violence. It also covers women who have been/are in a relationship with the abuser and are subjected to violence of any kind—physical, sexual, mental, verbal or emotional.

It is very difficult to prove , even though you have call recordings, he will defend if you file police complaint against him under mental cruelty/in general cruelty before police your father definitely reverse and says she is his friends wife/colleague or his friends wife, then the police automatically police will close the case by advising your mother and father to live happily. It is better take action against him before family court.

You can file under domestic violence act. Or you can even seek for divorce. You have to ask for compensation or permanent alimony for your mother and if necessary for you also. There are many options. .
