Jurisdiction / court for legal heir certificate

Parents have passed away. Am the only offspring. Parents aadhar is of Mulund, Mumbai. Mother has passed away in Bangalore while father in Mumbai. May need to close incometax account/PAN. Have been told by CA(s), that with updated norms , I need a legalheir certificate at the level of district court. Is this correct ? Which is the correct jurisdiction /court to apply for the same, thane or any other in Mumbai or Bangalore ? Lawyers knowledgeable of Mumbai practice may respond please for mumbai.

You seek an heirship certificate either in Mumbai of ag Thane depending on the properties your parnegs had either jn Mumbai or at Thane. Both the Courts have jurisdiction. Feel free to contact me for seeking any legal assistance as regards the same.

Well, In some cases, Legal Heirship Certificafe do the needful, in other cases, Succession Certificate will do the needful. After understanding facts of your case in detail, will suggest you, whether you apply for Legal Heirship Certificate or apply for the Succession Certificate to close Income Tax Account of your Parents!

The jurisdiction lies in Thane district court since Mulund falls under its limits. The correct jurisdiction is based on the deceased's permanent address or where the assets are situated. Apply there for the legal heir certificate.

For legal heir certificate the appropriate Jurisdiction is Bombay High Court if the property situated within Maharashtra and Goa. District court does not have jurisdiction for this. I don’t think it is so necessary for PAN closure. However if there is refunds eligible then may be required. Please be specific with respect to the assets and properties for which you need Succession Certificate

You can file a application for getting a legal heir certificate under section 2 of bombay regulation act. the document required to annexe with the application is : death certificate of the deceaseds. aadhar card of applicant. you can apply in mumbai with jurisdiction to mulund
