Yes, live-in relationships are not against the law in India.

As per law Live-in partners are presumed married but as one partner is already married and not divorced and if the other partner wasn't aware of the earlier marriage than the live in would be void. Can't say without all facts.

1)Is live-in legal in India - Thee is no clear cut law in regard to live - in relationship in india, however the court is considering the duo as Husband and Wife in regard to question related to family law wherein the parties shows themselves as husband and wife before public at large / society
2)What is the status of live-in when one partner was married before and still not divorced - If one partner in a live-in relationship is married and still not divorced then the female partner shall be treated as concubine in legal terms if both of them are residing with their consent.

In India, live-in relationship doesn't have specific law which says that its legal or illegal.
Its more a circumstantial matter and the status depends upon its exact facts like since how many times the are living together, do the have any child out of it and many other facts.
So can answer your question more specific if know exact situation.

its illegal, but you ask your partner to take divorce decree in his/her favour first, then after you go for further
