Is daughter responsible to pay father's loan
17-Feb-2025 (In Family Law)
My father passed away few years before. I am unmarried and elder at home. I have one brother who is married. He andr my mother are very selfish and they want me to pay my father's loan. I am IT professional.
Well, Deceased Father's Loan can be equally paid by other family members including you. Despite you are unmarried, as you may have been doing job via which you must be earning, if this is the case, then you not need to have any problem in contributing in paying Father's loan, legally, it is the responsibility of all children to pay Deceased Father's Loan!
If the loan was secured (e.g., against property), the lender may recover the dues from the mortgaged asset.
If it was an unsecured loan, legal heirs are not personally liable unless they inherit assets from their father.
If the deceased father's estate (property, savings, etc.) exists, the loan is to be repaid from that inheritance.
If the father left no assets, legal heirs are generally not personally liable to pay the loan from their own earnings.
Check Loan Documents: If you did not co-sign or guarantee the loan, you may not be legally responsible.
