I filed the case divorce against him after 1 year. Its been 9 yrs now I am fighting for the divorce. I have a 10 yrs old daughter with lives with me. My husband wants to torture me he is not ready for the divorce. He is very stubborn and not ready in any possible way for divorce. Q: Wife Threatening with DV, Dowry abuse and Harassment

My wife is a criminal lawyer herself. She put false claim of dowry abuse and harassment against me and my family and seeing that she knows how to put the fear of law in mine and my family's head, we agreed for mutual divorce on the condition that she takes the police complaint back and agreed to pay a full and final settlement amount. We paid her half of that settlement amount already but are now not able to pay the remainder. We are ready to fight back if she withdraws the mutual divorce petition, but i do not if she can again claim and malign mine and my family's name. What should we do in this case to safeguard ourselves.

Advocate Susmita Jagtap answered
it seems you paid half of the settlement amount and the mutual consent petition is still pending for want of dues to be paid by you. In that case you can file an application to the court about the inability to pay and can withdraw your consent for mutual divorce. You can contest the matter on merit and if the criminal complaint against you is false then you need not worry . you can also contest those cases if filed by your wife. need exact details though to give certain advice

This is issue about my grandmother that se is living seperately without her husband i.e my grandfather from 8 years.grandfather is a pensioner. Both sons take care of their mother. But now my grandma wants maintenance from her husband. Could she file a maintenance petition against her husband after 8 years? My grandfather filed divorce petition against her but she hasn't got Notice can be get EX parte divorce? Is there any limitation period for filing maintanence? What if he gets ex parte divorce and after will she be entitled for maintenance?

Advocate Susmita Jagtap answered
your grandmother is entitled to maintenance even after divorce. but if as you said no notice received by grandmother for divorce there can be no ex parte decree passed. She should appear in the divorce matter and also seek maintenance as interim order and then parmanent maintenance. can also file seperate maintenance petition. need more details for better advice. thanks
