Inquiry Regarding Monetary Gift Deed Execution Between Blood Brothers

30-Jun-2025 (In Family Law)
Can you guide me on executing a monetary gift deed between blood brothers in Maharashtra, including whether it should be before/after money transfer, steps, documents, charges, and tax rules? If I want an official record, do both need to visit the Sub-Registrar, and what’s the nominal fee? What are your professional fees, other costs (notary, stamp duty), and total estimated charges?

If you want to gift money to your brother in Maharashtra, it’s legally allowed and usually tax-free between close relatives. It’s advisable to prepare a proper Gift Deed, ideally before or along with transferring the money, to avoid future disputes. Registration isn’t strictly mandatory for cash gifts, but sometimes it’s wise for stronger legal proof. Both parties may need to visit the Sub-Registrar if you go that route. Each case can have its nuances, especially for larger amounts. Let me know the details of your situation, and I can guide you on the safest and most efficient way to proceed.

Hi, any property which is transferred for monetary consideration will attract stamp duty as applicable in case of conveyance. There are certain exceptions, in case of gift or release deed, however the same shall be without any monetary consideration.

To execute a monetary gift deed between blood brothers in Maharashtra, draft it on ₹200 stamp paper and get it notarised or registered. Both must be present at the Sub-Registrar. No tax if gifted to a blood relative. Registration ensures better legal validity.
