Inheritance of property from mother to only son

30-May-2023 (In Family Law)
In my case, I'm the only son of my parents and my father passed away few years back. The house we stay is in my mother's name and I would like to know, after her time whether it will be possible for me to get it in my name or my wife's name without a will.

Dear Sir, Get no objection (NOC) from your mother and try to get transfer the property in your name or get relinquishment deed from your mother and get transfer the property in your name. In either case he have to take the assistance of a local lawyer.

Yes it is possible to get in your name provided she is not having any daughters. But she should not make will in favour of some other or she should not sell property to someone else in her lifetime. if you are only child left to her then after her demise, you can get the property in your name without any hindrance. I understand from your case that you are the only child to your mother. So WILL is not required to get the transfer of the said property from your mother's name to your name after the demise of your mother. I hope your question is answered. If any further questions..write to us...
