indifferent, cruel and whimsical behaviour of husband towards family.

24-Jan-2023 (In Family Law)
I am a working woman, married to a central government employee since last 20 years. I have two children aged 18 years elder son and 12 years daughter. Since last three continuous years, my husband has been treating me and my elder son with verbal abuse, social discrimination, defaming and no financial support. He humiliates me and my son and does not allow us to keep relations with my ailing parents. I have tried all negotiations through family members and expected an assuring commitment from him or any of his relatives. But neither of them assure me anything, instead they keep defaming me and putting false allegations on me and my son saying we don't respect them. He is not giving any educational expenses to me for any of my children because he says I am not living with him. Please guide what can I do now?

start with legal notice for demand of maintenance claim for yourself and your children. Notice will elaborate circumstances under which you are forced to live separately. subsequent / parallel actions are required to be initiated without much delay. we should be able to assist you in your case. Hello Madam, it seems you husband is treating you with mental cruelty and to your children also which is also ground for divorce but I suggest you not to opt for divorce proceedings. I would suggest you to file proceedings under Sec 125 of CrPC before magistrate court and get monthly maintenance from husband and your children. Also, if he abuses are continuing with physical harm then you can file proceedings under Domestic Violence Act and can also get maintenance under he same along with protection order from court .
