Q: Property Ownership through Court Order

Hi,\n\nOur ancestral property(bungalow) was transferred to my father\'s name through a court order. Apart from court order, he also has CIDCO transfer document.\nIs the court order not enough evidence for ownership? Does my father has to execute a sale deed? If yes, then how will it be done in this case.\nThe issue is that banks are not taking this property as collateral without a valid sale deed.

If court order creates a right in favour of your father, which was non existent, the decree needs to be registered with SRO, which will become a title document. However, all facts need to be examined, to give exact answer to your query.

Are were into relationship and We married through court marriage. My wife was with me for 1 months, then my father-in-law asked her to come home to see her mother by giving reason as my mother-in-law is ill. Since then she is at her parents home. Her parents don't allow her to call, msg or any communication. They have also changed their address. So I am clueless. If I take any legal action against father-in-law then I am worried that she will not back to me. nI am totally depressed due to this situation, I want my wife to comeback to my home. Please guide me.

No, you all take share in the property as owners. Engage a lawyer, start with legal notice asserting your claim. you will be required to challenge the sale deed or seek share in the sale proceeds as an alternative. choose after consultation
