In-laws have acquired our property

Hello, Four years back me and my husband purchased the apartment. Our in-laws also contributed 17 lacs towards down payment. Total property worth is 75'lacs. Rest share is completely ours and property is in my husband's name. We stayed only 6 months later me n my husband moved to Malaysia. We now completely repaid the loan and we are in Singapore currently. Since we have a baby now and family expenditure more and our financial situation is not great, we are expecting income from our property in the form of rent. My in-laws are only staying in our apartment from the past 4.6 years , they are not ready to leave the house for us . They have 2 properties of theirs and they are getting huge rent from those. When we tried asking to give at least their house rent, they flatly rejected and not giving back us our home also. We have made up our mind to ask straight this time. So my question, is it legally wrong to ask our house back? What should we do if they don't leave the house?

in this case as your husband is the owner of the property he can file a suit for eviction of the in laws who are staying there and also claim mense profits till the property is handed over to you, menses profit means the income which the property can fetch if given on rent. so first talk to them and settle it out and if talks do not work then file a suit for eviction and also claim share in other 2 properties by filing a case of partition and separate possession if the other two properties are joint family properties.

Dear Madam,
There is no wrong for you to demand for return of house property since you are in-laws are having other properties to reside. The intention of in-laws may be studied before demanding back the house property. You can even file a suit for eviction since there are in illegal possession of the same.
