I want to legalize the denial of funeral rights for my husband

05-Jan-2023 (In Family Law)
I am a 33 year old woman with two children. I married my husband after being in a relationship for 5 years. After marriage, I have started to understand we are not a good match. There is always fights and I always feel that I am suffering a lot because of this marriage. I am actually holding on for this marriage for the sake of my kids. I have a very unique question. When I am dead, I dont want my husband to attend my funeral or do any last rites to me. I will be free from him at last when I am dead. How can I legalize it?

It is indeed an emotional decision. There is no specific way to legalize your wish except by way executing a Will. The existence of such a Will to your children and nearest ones. The contents of your Will is considered as your last wish and the same carries importance and legality.

for that you should have obtain legal divorce when you are divorced there is no husband and wife relationship so after that your husband has no right to conduct any funeral duties after your death when you are diversity but if you are not divorced and until the husband and wife relationship is continuing her husband has all the rights to do the funeral rites for you after your death
