Husband refuses to live and compels me to apply divorce

17-Nov-2023 (In Family Law)
I am 27 and married since last Nov. Due to some issues between my husband and me, my in laws are influencing my husband to divorce me. After huge fight, I came my hometown temporarily. I went back to my husband's place with my entire family to resolve issues and re-join with my husband. At that time, both families have argued and my MIL started beating me, my mom and my elder brother. I came back to my hometown. Now, my mom and brother wants me to complaint against my husband. If I don't they are telling me to leave the house. On other side, my husband is still in anger with me and asks me to apply mutual divorce at Chennai (place where we lived last) so only he'll handover my certificates to me. I don't have money or a job as of now to travel to Chennai. I don't want to complaint against my husband and also I want to live with him again against all our family members. How can I protect myself from my husband divorce notice and how can I avoid my parents' threat?

you have to setup a separate house at any one of the places either at home town or at Chennai. have a talk with your husband on this and get his consent and live with him. otherwise you have to run from your house and settled at your husband home

Hi, legally speaking it is better and a must to reply to your husband's legal notice saying that you want to live with him and don't want to divorce him. Try to find ways to talk to him one-to-one. Speak to him frankly and convey how important he is for you. Also try to avoid complaining about your in-laws at that particular time. Be patient and tell him the consequences of legal battles. Hope this is of some help to you. All the best

You can file a case under the domestic violence act through which you can get relief for residence, maintenance, return of your certificates, and more and you can file this case either in Chennai or at your place. Your appearance for the case is not required for all hearings except a few.
