Husband not sending monthly allowance what to do.

My husband is working abroad and is not sending money for me and my child. I am living with my parents now as my in laws are adamant that they cant let me stay at their place. My husband says whatever the consequences is I should stay with his parents otherwise he won't send money. He told me that if I want I can go legally about it and he will show me later what he can do. That is scaring me. What should I do? Pls help.

You dont need to worry. There are many things we can do in order to vindicate your rights and secure maintenance to both of you by him. But the decision should be taken very properly after a thorough perusal of the entire facts..

You can file a petition before the family court for the maintenance of you and your child from your husband. So you will get the chance for the Mediation with your in laws in front of the court officer(mediator)and your advocate.So file the petition as much as earliar

A Hindu male is legally obligated to maintain his spouse. Maintenance includes provision for food, residence, clothing, education and medical attendance and treatment.

The Supreme Court of India has held that no fixed formula can be laid for fixing the amount of maintenance. It has to be in the nature of things which depend on various facts and circumstances of each case. The court has to consider the status of the parties, their respective needs, the capacity of the husband to pay, having regard to reasonable expenses for his own maintenance and others whom he is obliged to maintain under the law and statute.

Don't forget that it is your duty to stay in husbands house with his parents. Amicable settlements is the best thing in family life other wise you can't to save a family life.
