Husband living in a rented house ask us to stay with him

in 15 years of marriage, we are joint family, my husband is only son. I have two kids.. but now due to family problems are worst... my in laws wants that we go seperate, but due to financialy condition we are not stay seperate in rented home. but my mother in law mind wash my husband and he agree to go rented home. Now he is staying at rented home. but i m staying there as i m not agree to go due to security of my kids. and my husband says that if you are staying with me then after i take resp of kids otherwise no.. Kindly advice what i do further?

You have a right to stay in an accommodation which belong to your husband. If your husband is staying in a rented accommodation you can approach a family court and ask for your rights. In a way of your not contended with the present state of livelihood you can go back to your matrimonial home. Further your kids also have right in the family property.

Responsibility of wife and kids is the prime responsibility of husband in marriage institution, if wife not earning and kids are minor or not self dependent.
If you qualify such conditions, then you are entitle to get maintenance from your husband for your lively hood.
It is the discretion of husband to decide where to reside at his ancestral home or separate rented home.

here u r very much rght not leaving matrimonial house because security reason but u did not disclose me whether house is own or rented if it is own who is regd owner of house . husband can not run away from responsibility after marriage hence u can file a case u/s 125 crpc for maintenance against your husband he is legally and morally bound to maintain u ad kids
