Husband has removed his personal belongings from our house

08-Feb-2023 (In Family Law)
My husband and i are having marital discord. he is in a govt job. So we are residing in a govt provided accommodation. Lately, he has removed his personal belongings from our house. He was somehow instigating me everyday that i get frustrated and leave the house. But I did not do that.I wanted to ask that in this way, after 6 months, can he file for divorce, citing that both of us have been residing separately since 6 months?

Dessertion can be a ground for divorce. But the period of seperation needs to be two years atleast. He can file on this ground only when two years or more than two years are completed of living in seperation.

No, not in this case. A divorce decree can only be granted within six months of separation of the spouse when it can be proved before the concerned court that it is one of the exceptional cases and husband and wife can't live together. After several efforts, it is not possible for both spouses to live together. Particularly under the facts above mentioned by you the above proposition works.
