Husband has filed for restitution of conjugal rights after abandoning

My Husband abandoned me when i was 5 weeks pregnant, he vacated the rental premises we were residing in even after me and my parents tried to stop him, he took back the security deposit and left with his belongings in June 2018. From that date neither he or any of his family members inquired about my health or pregnancy. I gave birth to a baby girl in Jan 2019 and did not call him to inform that, since there had been no involvement of him. He sent me a lawyers notice asking me to file for divorce in Feb 2019 and in March he sent me a Deed of divorce signed by him, asking to to sign which i did not. I raised a complaint at the commissioners office and when called for counseling he clearly said that he wants divorce and that he will not pay anything in maintenance for the child, since i am earning. Now, in Sept 2019 he has filed for restitution of conjugal rights. Can someone who deserted the wife and seeking divorce file for restitution of conjugal rights? What should I do?

first of all we will have to reply to the case of your husband

he has smartly filed for RCR and wants you to file for divorce

my suggestion
file a Domestic violence case and also a maintenance case against your husband and his other family members

first he should take responsibility of child and your

working women is also liable of maintenance she cant be ignored

Dear queriest, as per your query you have mentioned about the fact that your husband first deserted you and your daughter and now is filing for restitution of conjugal rights which is totally going on a wrong path, whatever you have said if it's true then you can file for maintenance immediately with the proofs of whatever he has sent to you through legal notice for signing divorce.

It is a trick. If you don't answer the restitution petition in a smart manner, he will show the court that you aren't ready to live with him and so a divorce shall be granted to him.

What is the status of divorce petition?
